Your accepted quotation, invoice, booking confirmation, final itinerary and any clearly disclosed supplier conditions form part of your agreement with Farmers Agro-Safaris. Trip-specific written terms take priority where they differ from this general page.
An enquiry or website form is a request only. A trip is confirmed after the required payment and written confirmation.
Lodges, airlines, parks, farms, conservancies and activity providers may impose their own payment and cancellation conditions.
Travellers should arrange suitable cover for cancellation, medical treatment, evacuation, baggage and planned activities.
1. Agreement, parties and scope
These Terms and Conditions apply to the Farmers Agro-Safaris website, enquiries submitted through the website or other communication channels, and bookings for safaris, agro-tourism experiences, farm visits, community visits, accommodation, transport, transfers, guided activities and related travel services arranged by Farmers Agro-Safaris.
In these terms, “we,” “us” and “our” refer to Farmers Agro-Safaris. “Traveller,” “you” and “your” refer to the person making the booking and, where appropriate, every person included in that booking. The person who confirms a booking is referred to as the lead traveller.
By using this website, accepting a quotation, paying a deposit or instructing us to proceed with a booking, you confirm that you have read and accepted the applicable terms and that the information supplied to us is complete and accurate.
Order of booking documents
If two booking documents appear inconsistent, they will generally be read in the following order, with the earlier item taking priority:

2. Use of this website
You may use this website to learn about our services, request information and communicate with our team. You must not use the website in a way that is unlawful, fraudulent, abusive, misleading, harmful to the website or likely to interfere with another person’s use of it.
You must not attempt to gain unauthorised access to the website, its hosting environment, databases, accounts or security features. Automated extraction, copying or scraping of substantial website content is not permitted without our written approval.
We try to keep website information accurate and current, but travel conditions, prices, taxes, park fees, supplier availability, routes, opening times and entry requirements can change. Website content is therefore general information until it is confirmed in writing for a particular booking.
We may update, suspend or withdraw any part of the website for maintenance, security, operational or business reasons. We do not guarantee that the website will always be uninterrupted, error-free or compatible with every device or browser.
3. Enquiries, quotations and booking confirmation
An enquiry, itinerary request, telephone discussion or submitted website form does not create a confirmed booking. It allows us to prepare or discuss a proposal based on the information provided.
A quotation is normally subject to availability at the time of confirmation. Unless the quotation states otherwise, accommodation, flights, permits, vehicles, guides and special activities may not be held while you consider the proposal.
A booking becomes confirmed only when:
- you have accepted the quotation or booking proposal in writing;
- we have received the required deposit or full payment in cleared funds;
- we have received the traveller and booking information reasonably required; and
- we have issued written booking confirmation.
The lead traveller confirms that they are authorised to act for everyone named in the booking. They are responsible for sharing the booking documents, payment requirements, safety information and applicable terms with the other travellers.
Travellers’ names must match their passports or other required travel documents. Any correction made after tickets, permits or reservations have been issued may be treated as an amendment and may attract additional charges.
4. Prices, deposits and payment
The currency, deposit, instalment dates, final balance date and accepted payment method will be shown in your quotation or invoice. Unless otherwise agreed in writing, payment is considered received when cleared funds reach the account specified by Farmers Agro-Safaris.

Where payment is made in a currency different from the invoiced currency, we may provide an applicable conversion amount. Any later difference caused by the bank’s rate, transfer timing or intermediary charges remains the payer’s responsibility.
If a payment is reversed, disputed or charged back without a valid basis, you remain responsible for the outstanding booking amount and any reasonable costs caused by the reversal, subject to applicable law.
5. Included and excluded services
Your accepted quotation and final itinerary are the main record of what is included. A service should not be treated as included merely because it appears elsewhere on the website or in a sample itinerary.
Commonly included when listed
- Ground transport, transfers and game drives shown in the itinerary.
- Accommodation and the meal plan specifically stated.
- Farm, community, wildlife or cultural activities expressly identified as included.
- Guide, driver-guide or tour-management services stated in the quotation.
- Park, conservancy, farm or activity fees expressly included in writing.
- Domestic flights specifically listed as part of the package.
Commonly excluded unless stated
- International flights and related departure or transit costs.
- Passports, visas, vaccinations, medical costs and travel insurance.
- Optional activities, tips, personal purchases, laundry and communication costs.
- Meals, drinks or room services not identified as included.
- Extra accommodation, transport or rebooking caused by delays outside our control.
- New or increased government and supplier charges not included in the confirmed price.
Park, conservancy and protected-area rules may regulate entry times, permit validity, re-entry, vehicle access and activity charges. Travellers must follow the current rules communicated by the relevant authority, supplier or guide.
6. Traveller changes, cancellations and unused services
All requests to change or cancel a booking must be made in writing by the lead traveller or an authorised representative. The effective date is the date on which we receive the request during normal business operations.
Changes to dates, destinations, names, rooming, activities, transport or group size are subject to availability and supplier approval. You must pay any difference in price, amendment fee, cancellation fee or non-refundable supplier cost created by the request.
A major change may require cancellation of the original booking and creation of a new booking at the prices and conditions available at that time.
Cancellation charges, peak-season conditions, non-refundable arrangements, refund calculations and processing are explained in the Farmers Agro-Safaris Cancellation Policy and in your accepted quotation.
No refund is normally available for a no-show, late arrival, early departure or service voluntarily missed after the trip begins. Where possible, we may assist with alternative arrangements, but the traveller is responsible for the resulting costs.
7. Traveller information and responsibilities
Each traveller is responsible for checking and obtaining the documents, permissions and personal arrangements needed for the trip. These may include:
- a passport with sufficient validity and blank pages;
- entry, transit and re-entry visas;
- vaccination certificates, health declarations or other health requirements;
- consent or custody documents for a child travelling without both legal guardians;
- driving permits where self-drive arrangements apply; and
- any permits required for personal equipment or specialist activities.
We may provide general information or supporting booking documents, but the traveller remains responsible for confirming current requirements with the relevant government, embassy, carrier, health authority or other official source.
You must provide accurate names, ages, nationalities, contact information and other booking details. You must also tell us, as early as possible, about allergies, dietary requirements, mobility needs, medical conditions, pregnancy, medication or other circumstances that may affect safe participation or the suitability of an itinerary.
Special requests are not guaranteed unless expressly confirmed in writing. Some remote farms, camps, vehicles, trails and wildlife areas may have limited accessibility or medical support.
8. Farm, community, wildlife and outdoor experiences
Agro-safaris and rural travel may involve working farms, livestock, wildlife areas, uneven ground, dust, mud, insects, changing weather, machinery, water features and locations far from immediate medical services. Travellers must use reasonable care and follow instructions from guides, hosts, drivers, rangers and property staff.
Farm operations, crop cycles, harvest activity, livestock routines, wildlife sightings and weather-dependent experiences cannot be guaranteed. A host may modify or cancel an activity where participation would disrupt operations, compromise animal welfare, damage crops, create a biosecurity concern or present an unreasonable safety risk.
Travellers must respect host communities, cultural expectations, private property, conservation rules and photography restrictions. Images or recordings of local people, children, private homes, farm operations or restricted areas should only be taken after appropriate permission.
A traveller may be refused participation or removed from an activity where their behaviour is unsafe, unlawful, abusive, seriously disruptive, intoxicated, damaging to property, harmful to animals or contrary to reasonable instructions. Any additional costs caused by removal are the traveller’s responsibility, and refunds are not normally available for the affected service.
9. Third-party suppliers and itinerary changes
We arrange many trip components through independent suppliers, including hotels, lodges, camps, farms, communities, airlines, transport operators, parks, conservancies, guides and activity providers. Those suppliers are responsible for delivering their services under their own operating, safety and booking conditions.
We select and coordinate suppliers with reasonable care, but we do not control every operational decision they make. Supplier-specific rules may apply to baggage, check-in, room use, permits, activities, age limits, health requirements, cancellations and refunds.
We may change the sequence, timing, route, accommodation, vehicle, guide or activity where reasonably required by safety, weather, road conditions, wildlife movement, farm operations, conservation rules, government action, transport disruption or supplier availability.
Where a significant confirmed service becomes unavailable, we will make reasonable efforts to provide a suitable alternative. An alternative may not be identical but will be selected with regard to the itinerary’s purpose, location, standard and practical availability.
If a traveller rejects a reasonable alternative and makes independent arrangements, the resulting costs are their responsibility unless we agree otherwise in writing.
10. Travel insurance and acceptance of ordinary travel risk
Travellers should obtain comprehensive travel insurance as soon as the booking is confirmed. The policy should be appropriate for the destination, traveller circumstances and planned activities, and should normally include cancellation or curtailment, medical treatment, emergency evacuation and repatriation, baggage, personal liability and travel disruption.
It is the traveller’s responsibility to read the insurance terms, disclose relevant medical information and confirm that the planned activities are covered. Farmers Agro-Safaris is not an insurer and cannot decide whether a claim will be accepted.
Travel, road transport, wildlife viewing, farm visits and outdoor activities carry ordinary and sometimes unavoidable risks. By participating, travellers acknowledge those risks and agree to follow the reasonable safety measures put in place by us and the relevant suppliers.
11. Events beyond reasonable control
Farmers Agro-Safaris is not responsible for failure or delay caused by circumstances outside our reasonable control. These may include severe weather, natural disaster, fire, epidemic, quarantine, border closure, government action, civil disturbance, war, terrorism, strike, transport interruption, fuel shortage, infrastructure failure, protected-area closure or a serious security incident.
Where such an event affects a booking, we may adjust, postpone, substitute or cancel affected services. Available options will depend on safety, practicality, supplier conditions and the amounts recoverable from suppliers. Additional costs may be payable by the traveller, particularly where extra accommodation, transport or rebooking is required.
12. Responsibility and limitation of liability
We are responsible for providing the services that we directly operate with reasonable care and for arranging the booked itinerary as described in the confirmed documents, subject to these terms and any agreed changes.
To the extent permitted by law, we are not responsible for loss, delay, expense, injury or disruption caused by:
- incorrect, incomplete or late information provided by a traveller;
- a traveller’s failure to obtain documents, insurance or medical advice;
- a traveller’s breach of law, supplier rules or reasonable safety instructions;
- independent acts or omissions of third-party suppliers that we could not reasonably prevent;
- events beyond our reasonable control; or
- voluntary decisions to leave, alter or not use the confirmed arrangements.
Nothing in these terms excludes or limits a right, remedy or responsibility that cannot lawfully be excluded. Where liability may lawfully be limited, our total liability in relation to a booking will not exceed the amount paid to Farmers Agro-Safaris for the affected booking, except where a different limitation is required by applicable law.
Farmers Agro-Safaris is not liable for indirect or consequential loss, loss of opportunity, loss of enjoyment, loss of business or other loss that was not reasonably foreseeable when the booking was made, to the extent such exclusion is permitted by law.
A traveller is responsible for reasonable loss or damage caused by their unlawful, negligent or deliberately harmful conduct. This includes damage to vehicles, accommodation, farm property, equipment, crops, animals or third-party property.
13. Personal data, communications and website content
Personal information
We process personal information to respond to enquiries, prepare quotations, manage bookings, arrange travel services, communicate important updates, maintain records, meet legal obligations and protect legitimate business and security interests.
Booking information may be shared with relevant suppliers and authorities where reasonably necessary to deliver the trip or meet legal, immigration, security or public-health requirements. More detail should be provided in the Farmers Agro-Safaris Privacy Policy and Cookie Policy.
Essential booking communications may include invoices, itinerary updates, travel documents, operational notices and post-service administration. Marketing messages will be handled according to the preferences and rights described in the Privacy Policy.
Intellectual property
Unless stated otherwise, the website design, Farmers Agro-Safaris name and branding, original text, itinerary descriptions, graphics, photographs, videos and other original material are owned by or licensed to Farmers Agro-Safaris.
You may view and print a reasonable amount of website content for personal trip planning. You may not reproduce, republish, sell, alter, distribute or commercially exploit substantial website content without written permission.
External links and user-provided material
Links to third-party websites are provided for convenience and do not mean that we control or endorse all content on those websites. Third-party sites operate under their own terms and privacy practices.
When you send reviews, photographs, itinerary ideas, feedback or other material, you confirm that you are entitled to provide it and that it does not unlawfully infringe another person’s rights. We will not publish identifiable traveller material for marketing without an appropriate permission or other lawful basis.
14. Problems, complaints and dispute resolution
A traveller should report a problem as soon as possible to the guide, host, supplier or Farmers Agro-Safaris contact so that a practical solution can be attempted while the service is taking place.
A formal complaint should be submitted in writing and should include the booking reference, traveller name, dates, a clear description of the issue, the steps already taken and any relevant documents or photographs. Prompt reporting helps us investigate while information is still available.
We will review complaints in good faith and may need to obtain information from suppliers. The time required will depend on the nature of the issue and the response time of the organisations involved.
Governing law and jurisdiction
These terms and bookings made with Farmers Agro-Safaris are governed by the laws of the Republic of Kenya, unless mandatory law requires otherwise. The parties should first try to resolve a dispute through direct written discussion. Where a dispute cannot be resolved, it may be submitted to the courts or another lawful dispute-resolution process with jurisdiction in Kenya.
Severability, waiver and assignment
If a provision of these terms is found invalid or unenforceable, it will be applied to the greatest lawful extent and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.
You may not transfer a booking or your rights under it to another person without our written agreement and any required supplier approval. We may transfer or subcontract operational responsibilities where reasonably necessary, provided this does not remove any responsibility that cannot lawfully be transferred.
15. Updates to these terms
We may update these website terms to reflect changes in our services, website, suppliers, operational practices or legal obligations. The updated date shown at the top of the page identifies the current published version.
The terms applicable to a confirmed booking are normally those accepted when the booking was made, together with any later change agreed in writing or required by law. Publishing revised website terms does not by itself rewrite an existing confirmed booking.
